   Your order constitutes an offer to purchase artwork. A legally binding contract is only formed when we send you an express email confirmation accepting your order and confirming dispatch. We reserve the right to decline any order for any reason.

3. Pricing and Payment
   All prices are displayed in GBP. Prices exclude delivery charges, which will be calculated and added at checkout. Payment must be made in full at the time of ordering via our secure payment processors. If you are ordering from outside the UK, you are solely responsible for any local import duties, taxes, or customs clearance fees.

4. Purchase vs. Copyright Ownership
   The purchase of an original artwork, limited edition print, or any physical item from this shop transfers ownership of the physical object only. It does not transfer any copyright or commercial reproduction rights to the buyer. Philip Smyth retains all rights to reproduce, print, license, and commercially exploit the artwork imagery. You may not scan, copy, resell prints of, or merchandise the artwork in any format.

5. Delivery
   We will deliver the artwork to the shipping address provided during checkout. We aim to dispatch items within 3 working days. In accordance with UK law, delivery will be completed within 30 days of order acceptance unless a longer timeframe is explicitly agreed upon for commissions or bespoke work. Risk of damage or loss passes to you upon delivery.

6. Statutory Right to Cancel (14-Day Cooling-Off Period)
   Under the UK Consumer Contracts Regulations 2013, you have the right to cancel your purchase and receive a full refund for any reason within 14 days of receiving your artwork.
   Exceptions: This cancellation right does not apply to custom commissions, bespoke framing, personalized items, or digital downloads once the download has commenced.
   To exercise this right, you must notify us in writing via email within the 14-day window. You must return the artwork to us in its original condition and packaging at your own expense within 14 days of your cancellation notice. We will process your refund, including standard delivery costs, within 14 days of receiving the returned item.

7. Faulty or Misdescribed Items
   In accordance with the UK Consumer Rights Act 2015, if the artwork arrives damaged, faulty, or does not materially match the online description, you have a statutory right to a repair, replacement, or full refund. Please inspect the artwork immediately upon arrival and contact us within 30 days of delivery to report any issues. We will cover the cost of return shipping for faulty items.

8. Art and Display Disclaimer
   We make every effort to display the colors, textures, and details of the artwork as accurately as possible. However, digital screens display colors differently, and we cannot guarantee that your monitor or phone screen will perfectly replicate the exact tones of the physical artwork. Small natural variations are an inherent part of original art and hand-made prints.

9. Limitation of Liability
   We are not liable for any damage caused to the artwork after delivery due to improper framing, exposure to direct sunlight, moisture, extreme temperatures, or general mishandling. Our total liability under this contract is strictly limited to the total purchase price paid for the artwork.

10. Governing Law
    These terms are governed by English law, and any disputes will be subject to the exclusive jurisdiction of the courts of the United Kingdom.
